Occupancy Certificate for Small Houses in Bengaluru: Who Is Exempt?
Is an occupancy certificate needed for a 30x40 house in Bengaluru? What the reported 2025 and 2026 exemptions say and what still applies.
In Greater Bengaluru, a Greater Bengaluru Authority order dated 9 September 2025 exempts small residential buildings on plots up to 1,200 sq ft from the occupancy certificate (OC). A June 2026 order, as reported by Deccan Herald, added a one-time relaxation for completed homes on plots up to about 2,400 sq ft. A sanctioned plan is still needed before building. Confirm with your architect. As of Nov 2026.
What is an occupancy certificate? An occupancy certificate is the civic authority's confirmation that a finished building matches its sanctioned plan and is fit to live in. It has long been needed for permanent power and water connections. Small residential buildings in Greater Bengaluru have been exempted under conditions, set out below.
Why the OC became a big deal for house owners
For years, many individual houses were built without an OC, and owners lived on temporary power. In December 2024 the Supreme Court, in Rajendra Kumar Barjatya v. U.P. Avas Evam Vikas Parishad, directed that electricity, water and sewerage connections be given only after a completion or occupation certificate is produced; we read this as quoted in a Telangana High Court order of 31 July 2025. Greater Bengaluru then issued exemptions for small residential buildings.
What the orders say
| September 2025 exemption (GBA order) | June 2026 relaxation (as reported) | |
|---|---|---|
| Plot size | Up to 1,200 sq ft | Up to 2,400 sq ft, with a 20% permissible variation |
| Building type | Residential | Completed residential buildings without an OC |
| Floors | Ground + 2, or stilt + 3 | Not stated in the report we read |
| What it unlocks | Exemption from the OC requirement | One-time application for power supply, using a geo-tagged photograph |
The left column is from the order itself: a Kannada-language Greater Bengaluru Authority order dated 9 September 2025, which cites section 241(7) of the Greater Bengaluru Governance Act, 2024. The right column is from Deccan Herald's June 2026 report on the BESCOM window. We have not read that second order, and reports differ on its date, so we state none. Treat the right column as reported, not as legal text. Whether the 20% variation applies to the plot size or to another measure is not clear from the report.
Where common plot sizes fall
| Plot | Area | Against the reported limits |
|---|---|---|
| 20x30 | 600 sq ft | Inside the 1,200 sq ft limit |
| 30x40 | 1,200 sq ft | Exactly at the 1,200 sq ft limit |
| 30x50 | 1,500 sq ft | Above 1,200; ask which order applies |
| 40x60 | 2,400 sq ft | At the June 2026 figure; ask which order applies |
Plots sold by dimension are often slightly larger or smaller than the label, so check the area in your deed.
What you still have to do
'No OC' does not mean 'no rules'. As a general principle, the sanctioned plan comes first:
- Get building plan approval before you build. The OC exemption concerns the final certificate, not permission to start.
- Follow the sanctioned plan. Setbacks, FAR, height and safety rules still apply. See our guides on setbacks and FAR.
- Do not expect an amnesty. We have found nothing that regularises construction built outside the sanctioned plan, so assume none exists and ask your architect.
So an OC-exempt house is still a sanctioned, rule-following house. Rules change; confirm with your architect or the authority.
Worked example: a 30x40 G+1 house
A 30x40 plot is 1,200 sq ft, so it falls inside even the original September 2025 limit, and a G+1 or stilt+3 home is within the floor limits in that order. The owner gets the plan sanctioned, builds to it, and, if the exemption still applies when the house is complete, does not apply for an OC. A 40x60 plot (2,400 sq ft) is above that first limit, so ask the authority which order covers it.
Check the plot area on your sale deed or khata, not the one you assume. A plot sold as 30x40 can be a little over or under, and a limit is a hard line.
What about BESCOM and BWSSB?
This is where owners get stuck. In June 2026 BESCOM ran a one-time window for completed residential buildings on plots up to 2,400 sq ft (with 20% variation) that were finished by 31 May. Owners with a pending application, a temporary connection or no connection could apply for power with a geo-tagged photo of the building. Deccan Herald reported the deadline as 6 July 2026, so the window is over as of Nov 2026.
For a house you build now, how BESCOM and BWSSB treat the exemption for a fresh application is a question for them. We could not confirm a current written procedure. Our guide to BESCOM and BWSSB connections lists what we could verify.
One practical point: write the plot area and the sanctioned floor count on the first page of your file, and confirm both against the current order before you pour the first slab.
If your house is bigger than the limit
Then the normal OC process applies: the authority inspects the completed building against the sanctioned plan and issues the certificate. Building above the sanctioned plan is the usual reason an OC is refused, which is why FAR and setbacks matter from day one.
Should you still keep OC-style paperwork?
Even when the OC is waived, keep a clean file. Banks, buyers and insurers like to see documents. A good minimum set:
- Sanctioned plan and licence
- Structural drawings and the engineer's stage reports
- Photographs at each stage (footing, columns, slabs)
- The government order that exempts your plot size, with its date
- Concrete cube test reports
Why the exemption exists, and why it is not a free pass
The point of an OC is to confirm the building was built as sanctioned. Whatever the reason for the exemption, it removes only that last step. The risk now sits more with you, because nobody issues a certificate saying the house matches the plan. A site engineer who keeps stage-wise records, and a builder who works strictly to the sanctioned drawing, become your proof. Dated photographs, cube test reports and the engineer's inspection notes cost little and are useful if a buyer or a bank asks questions years later. At Buildryt, test reports are filed in the app before you approve each stage.
What to ask your builder
- Is my plot area, as per the deed, inside the exemption limit with room to spare?
- Will the building plan be sanctioned before work starts, and can I have the copy?
- If extra floor or area is added midway, who re-checks the limit?
- Which documents will I hold at handover for the bank, BESCOM and BWSSB?

Frequently asked questions
Do I need an occupancy certificate for a 30x40 house in Bengaluru?
Not under the Greater Bengaluru Authority order dated 9 September 2025, which exempts residential buildings on plots up to 1,200 sq ft (ground + 2 or stilt + 3), and a 30x40 plot is exactly that. You still need a sanctioned building plan before you build, and the house must follow it. Confirm the current order with your architect.
What is the plot size limit for the OC exemption now?
The GBA order of 9 September 2025 sets plots up to 1,200 sq ft. A June 2026 state order, as reported by Deccan Herald, gave a one-time relaxation for completed homes on plots up to 2,400 sq ft with a 20% variation. Check the exact order text and your deed's plot area with your architect.
Does the OC exemption mean I can skip plan approval?
No. Plan approval is needed before construction, whatever the size. The exemption concerns only the final occupancy certificate. Setbacks, FAR, height and safety rules still apply to your sanctioned plan. Rules change; confirm with your architect or the authority before you start work on site.
Can I get a BESCOM connection without an OC?
A one-time BESCOM window in June 2026 allowed eligible completed houses on plots up to 2,400 sq ft to apply with a geo-tagged photo, and Deccan Herald reported it closing on 6 July 2026. For a house you build now, ask BESCOM for the current written procedure.
What documents should I keep if my house is OC-exempt?
Keep the sanctioned plan and licence, structural drawings, dated stage photographs, concrete test reports, the engineer's inspection notes and a copy of the government order that exempts your plot size. Banks, buyers and utilities may ask for them years later, so store copies on paper and on your phone.
